Work Permit – list of Occupational Shortage

All of the applications that you, as an employer, make for a work permit are ultimately dealt with by the Home Office Border and Immigration Agency. Any applications that are presented to Immigration Consult will be sent to the Home Office Border and Immigration Agency for approval. They tend to try and deal with these applications within one or two weeks.

Just to remind migrants hoping to gain a work permit it is your potential employer who will apply for the work permit on your behalf and no action is needed directly from you within this process.

The length that it takes for the Home Office Border and Immigration Agency to process applications for work permits depends on whether the employment position is required to be advertised. If you need to advertise your employment position then the process will take longer.

In order to apply for a work permit to fill a position that needed to be advised you need to prove the following:

  • The chosen candidate is experienced enough to be granted a work permit
  • Candidate has a UK degree equivalent qualification or three years senior level experience or a HND level occupation or an NVQ at level three or above
  • The vacancy cannot be filled by an EEA worker and that you have gone to great lengths to employ an EEA resident by using aspects such as press, trade journals and the Internet
  • You have allowed four weeks for any responses to the job being advertised

In order to establish the type of jobs that require to the need to be advertised, read the following; if the job isn’t stated or has no relevance to the following then you will need to advise it before applying for a work permit.

Advertising is not needed for the following:

  • The position is on a board of directors and you will be reporting directly to the board of directors
  • The position is for a high level executive
  • Position requires someone with skills that is on an official shortage list, which includes healthcare, teaching and engineering
