Indefinite Leave to Remain is a UK visa service that grants successful applicants permanent Residence in the UK. Applications for Indefinite Leave to Remain can be made by people who have previously been successful in applying for a visa in the UK as long as they have done so in a category that has the option of leading to permanent settlement.

Indefinite Leave to Remain has no time limit imposed on it and there are also no immigration related restrictions placed on it, for example you don’t need to have found employment before applying to come to the UK. There are also no restrictions on the type of work that you undertake on arrival.

It should be noted however that it is important that if you are granted Indefinite Leave to Remain in the UK that you don’t spend longer than two years outside of the UK as you should consider the UK as your home and having long periods of time away could result in you losing your Indefinite Leave to Remain status.

Another aspect of Indefinite Leave to Remain is that a person may be eligible to apply for British naturalisation to become a UK citizen, as long as they meet the requirements for British citizenship. If you would like more information about applying for British citizenship please feel free to get in touch with Immigration Consult.

You can apply for Indefinite Leave to Remain if you have been in the UK on any of the following visas for the allocated amount of time:

Highly Skilled Migrant Programme (HSMP) or work permit 5 Years
Ancestry 5 Years
Marriage 2 Years
Unmarried Partners 2 Years
Investors 5 Years
Writers, Composers or Artists 5 Years
Sole Representatives 5 Years
Persons establishing themselves in Business 5 Years
Unlawful stay or a combination of lawful and unlawful stay 14 Years
Lawful stay on any basis 10 Years

Please note that some of the times needed to gain permanent residence changed on April 3, 2006. People applying for permanent residence will be required to take the "Life in the UK" test.
