This visa allows applicants who are planning to marry a British citizen or permanent resident in the UK to apply on the basis of being a fiancée. The requirements of applying for this visa are a lot like the requirements surrounding the application of a UK marriage visa; there is however one significant difference, which is that, unlike many family visas, there are no requirements that state the applicant and partner have to live together before applying.

The requirements needed to apply for a UK Fiancée Visa are as follows:

  • You must intend to get married within a six month period. If there are exceptional reasons for delaying marriage until after the initial six months an extension to stay in the UK may be granted
  • You must have met each other.
  • You must intend to live together permanently.
  • There must be evidence that you can support yourself, or be supported by your partner, without access to public funds.
  • There must be adequate accommodation in place.
  • It is a requirement that the overseas fiancé/fiancée has to be 16 years old or over, and the partner in the UK has to be at least 18 years old
  • Children of the overseas fiancé/e who are under 18 years old are only allowed entry to the UK as dependants if it can be shown that it would cause serious problems if they are not allowed entry at the same time. Therefore this sort of application will be difficult to make, and in many cases it may be best to wait until after the marriage and then apply for a UK marriage visa.

There are certain conditions surrounding a successful UK fiancée visa application; successful applicants are granted a six month visa to come to the UK and get married. This six month visa does not allow an applicant to take up work within the UK.

Only if the marriage has successfully taken place will you then be able to apply for a UK marriage visa. If you are successful in your UK marriage visa application you will be able to spend two years living and working in the UK. If after these two years the relationship is still going strong you can then apply for Indefinite Leave to Remain (ILR).
